What's Changed

Kentucky Equal Employment Opportunity

In August 2024, Kentucky released its guidelines on the Equal Employment Opportunity (EEO) with specific changes related to pregnancy under the Pregnant Workers Fairness Act (PWFA). The PWFA requires employers with 15 or more employees to provide reasonable accommodations to workers for conditions related to pregnancy, childbirth, or related medical conditions. The act now explicitly states that accommodations must be provided even if the employee is temporarily unable to perform an essential function of the job, as long as they will be able to perform it in the near future.

For more details, you can review the official guidance on the Pregnant Workers Fairness Act on the EEOC's website or or consult with an employment lawyer familiar with Kentucky labor laws.
