Missouri's new Earned Paid Sick Time Law, enacted through Proposition A, took effect on May 1, 2025. This law mandates that most private employers in Missouri provide paid sick leave to eligible employees.

  • Accrual Rate: Employees accrue one hour of paid sick time for every 30 hours worked.


  • Annual Usage Limits:

    • Employers with 15 or more employees: up to 56 hours per year.


    • Employers with fewer than 15 employees: up to 40 hours per year.




  • Carryover: Employees may carry over up to 80 hours of unused paid sick time into the following year. Alternatively, employers can pay out unused time at year-end and frontload the next year's allotment.


  • Usage: Paid sick time can be used for the employee's or a family member's illness, preventive care, or needs related to domestic violence.


  • Notice Requirements:

    • Employers were required to provide a written notice to employees by April 15, 2025, detailing their rights under the law.


    • A workplace poster summarizing the law must be displayed in a conspicuous location.




  • Recordkeeping: Employers must maintain records of hours worked and paid sick time used for at least three years.



Legal Challenges and Legislative Actions



While the law is currently in effect, it has faced legal and legislative challenges:




  • The Missouri Supreme Court upheld the law against constitutional challenges, affirming its validity.


  • Legislation (House Bill 567) aimed at repealing the paid sick leave provisions was passed by the Missouri House but is pending in the Senate. If enacted without an emergency clause, the repeal would not take effect until August 28, 2025, meaning employers must comply with the law until that date.
