Starting January 1, 2021, the New York State postings for minimum wage and child labor have been updated.



Previously, New York's state minimum wage was last updated in July 2020. Starting December 31, 2020, employers must pay the full minimum wage rate - tip credit does not apply anymore.





  • New York City employers: Minimum wage $14.00/hr (including tipped workers, for both large and small employers)
  • Long Island & Westchester County: Minimum wage $14.00/hr (including tipped workers)
  • Remainder of New York State: Minimum wage $12.00/hr (including tipped workers)


The New York State Child Labor Law has also been updated for 2021 (last update was in 2016). The New York State Department of Labor offices were updated to the following:



  • Buffalo District: 290 Main Street, Room 226
  • Binghamton Sub-district: Removed
